Terms and Conditions of the Huddig Care Service Agreement

1. Definitions and Scope

These terms and conditions apply to vehicles covered by a Huddig Care service agreement.

The term " machine " refers to the vehicle covered by this agreement.

The term " customer " refers to the owner of the machine.

" Supplier " refers to Huddig AB.

Huddig AB defines an " authorized service partner " as dealer approved dealer service center.

" Service " refers to the work, inspections, and maintenance performed in accordance with Huddig’s current original instruction manual and service schedules, at specified service intervals.

2. Scope

The agreement covers service in accordance with Huddig’s current service schedules and applies nationwide within the country where the contracting parties operate. The agreement includes a return fee for oils and fluids used during field service.

The machine will be covered under the terms of this agreement starting on the effective date and will expire on the date the machine reaches 4,499 hours, the engine’s operating hours as recorded by the hour meter, or the date three years have elapsed from the effective date.

Service must be performed by an authorized service partner and can be carried out by any of the affiliated workshops covered by the agreement, as listed under Huddig service provider Find service and support.

The service is performed during the authorized service partner's regular business hours.

3. Obligations of Authorized Service Partners

Included in the agreement

The authorized service partner agrees to:

  • Perform maintenance in accordance with the machine’s instruction manual, as well as Huddig’s current maintenance schedules and established maintenance intervals.
  • Perform an annual inspection of the air conditioning system.
  • Follow up with the customer after service, which includes reviewing the work performed and providing a service report that includes any comments and action items.
4. Beyond the scope of authorized service partners' responsibilities

Not included in the agreement

The following are not covered by the agreement:

  • Perform daily maintenance in accordance with the machine's instruction manual.
  • Repairs performed at the customer’s request outside the scope of this agreement.
  • Compensation for travel time and mileage to and from the machine.
  • Cleaning the machine as part of routine maintenance.
  • Oil for the hydraulic system.
  • Recharging the AC system with refrigerant.
  • Topping off oils and fluids between regular service intervals.
  • Trailer and shipping costs for transporting the machine. The authorized service partner will determine whether the work can be performed on-site or if the machine must be transported to a workshop.
  • Circumstances beyond the service partner’s control that affect response time or material consumption, such as force majeure events.
  • Overtime work performed outside the authorized Huddig retailer’s regular business hours and requested by the customer.
  • Service or maintenance of accessories such as Rototilt, loader cranes, LCC, and other retrofitted components installed by Huddig, dealer, ÅF, or another service partner.
  • Operational and production losses, regardless of the cause.
5. Customer Obligations

The customer agrees to:

  • Use the machine, or ensure that it is used, in a safe, lawful, prudent, and professional manner, in accordance with its intended uses and the instruction manual.
  • Contact dealer Huddig dealer advance to schedule service and maintenance work covered by this agreement. All service and maintenance work must be performed within 100 hours of the specified interval. It is the customer’s responsibility to schedule planned service well in advance. The authorized service partner has the final say in determining service and scheduling.
  • Supply fuel and exhaust emission control fluids.
  • Perform daily maintenance and keep a log in accordance with the manual.
  • Ensure that the machine is cleaned and available for service at the scheduled service intervals.
  • Ensure that the work environment is safe and suitable for the contractor to perform work in. This includes, for example, removing any equipment that hinders service before the service is performed.
  • Make payments to the dealer in accordance with this agreement, subject to the terms and procedures set forth herein. In the event of a late payment, the dealer has the right to postpone the performance of service work until full payment has been made.
  • Please contact your nearest authorized Huddig dealer service partner to schedule service outside your regular service area.
6. Term of validity
  • The agreement is available for the Huddig 1260E and 1370 models.
  • The term of validity is specified in the agreement and is tied to the specific machine.
  • The agreement automatically terminates at the end of the term.
  • In the event of early termination, a final settlement will be made based on the actual driving time in relation to the agreed annual driving time. The final settlement may result in a final invoice.
  • Huddig AB reserves the right to unilaterally amend the terms of the agreement by providing written notice at least one (1) month prior to the effective date. The customer has the right to terminate the agreement if the amendment is not accepted.
7. Fees
  • All prices are listed in Swedish kronor (SEK), excluding VAT.
  • This agreement is adjusted for inflation once a year in accordance with the Labor Cost Index (LCI) published by Statistics Sweden (SCB).
  • Payment shall be made upon receipt of an invoice, with a payment term of thirty (30) days from the invoice date, unless otherwise agreed in writing.
  • In the event of late payment, late payment interest of ten (10) percent will be charged in accordance with the Interest Act.
  • In the event of repeated failure to make payments, Huddig AB reserves the right to terminate the agreement with immediate effect.
8. Huddig Spare Parts
  • During service and maintenance, Huddig genuine replacement parts and fluids should be used whenever possible.
  • If this is not possible, products of equivalent quality may be used after consulting with Huddig AB.
9. Customer Delay
  • If the customer is unable to provide the machine at the agreed time, this must be reported immediately.
  • An authorized service partner has the right to claim reimbursement for costs incurred as a result of the service not being able to be performed.
10. Delay by an authorized service partner
  • If service cannot be provided at the agreed time, the customer must be notified immediately.
  • The customer has the right to set a reasonable deadline.
  • If this is not done, the customer may have the work performed by themselves or by another contractor.
  • Additional costs will be reimbursed by the service partner, except in cases of force majeure.
11. Documentation
  • The service report must be provided to and reviewed with the customer after the service has been completed.
  • The customer must keep a log of daily inspections.
  • The parties may not disclose confidential information to third parties without consent.
12. Warranty Period and Complaints
  • The authorized service partner is responsible for any defects in the service provided during the term of the agreement.
  • Complaints must be made without undue delay.
  • Failure to file a complaint results in the loss of the right to claim a defect.
13. Modification of the machine
  • The customer must notify dealer designated dealer in writing dealer any changes or modifications made to the machine that affect the service points.
14. Termination of the Agreement

This agreement automatically terminates:

  • On the expiration date specified in the contract.
  • When the maximum number of operating hours for the machine specified for the contract period has been exceeded.

The retailer or supplier reserves the right to terminate the agreement with immediate effect and without prior notice by notifying the customer in writing via certified mail under the following circumstances:

  • Failure to make or delay in making a payment as agreed.
  • When the machine is exported.
  • If the customer becomes insolvent, files for bankruptcy, or is otherwise involved in such proceedings.
  • When the machine is used and/or maintained by a third party without the dealer’s approval.
  • Ownership of the machine has been transferred or the machine has been leased to a third party.
15. External Factors

Force majeure
  • The parties shall be exempt from liability in the event of unforeseeable circumstances beyond their control, such as government decisions, war, labor disputes, natural disasters, fire, or similar circumstances.
16. Dispute
  • Disputes shall be settled by arbitration in accordance with the laws of the supplier’s country. However, Huddig AB reserves the right to bring payment disputes before a court of general jurisdiction.
